An Interlibrary Loan (ILL)
form should be completed when one library requests from
another library a copy of a work protected by copyright.
Some of the rules applicable to the form are documented
under the CONTU Guidelines.
Completing the ILL Form
The interlibrary loan form asks the library staff to indicate
either "CCG" or "CCL" when making
a request. Here is some information on making the choice.
Check CCG (Conforms to
Copyright Guidelines):
- When the request is within quantities set forth
in the CONTU guidelines; or
- When the requesting library has ordered a subscription
to the publication; or
- When the requesting library's own copy is unavailable.
Check CCL (Conforms to
Copyright Law):
- When the requesting library considers the copy
a “fair use;”
- When a copy is requested from periodical over five
years old;
- If the request is for an entire work or substantial
part and where requesting library cannot obtain an
unused copy at a fair price;
- When the requested copy becomes part of the collection
of the requesting library and
- the requested facsimile or digital copy of a published
work replaces damaged, deteriorating, lost or stolen
work for which unused copy could not be found at
fair price; or
- the requesting library believes the copy is covered
under “fair use."
Responsibilities of Library Borrowing the Copy
The borrowing library must keep the ILL records, both
requests and fills, through the end of the third calendar
year after the end of the calendar year in which the request
was made.
Responsibilities of Library Providing the Copy
The providing library must ensure that copyright notice
appears on the copied material.
