RESOLUTION

concerning

Copyright Policy and Educational Program

at

The Connecticut State University System

December 10, 2004



WHEREAS, The TEACH Act (The Technology, Education, and Copyright Harmonization Act) requires that non-profit educational institutions have a copyright policy/educational program in place to enable distance education faculty to enjoy enhanced copyright privileges under copyright law, and

WHEREAS, The TEACH Act co-exists with Fair Use (Section 107 of the Copyright Law) and with the special privileges granted to libraries under Section 108, and

WHEREAS, The Connecticut State University System and its four universities complies with the United States Copyright Law, Title 17 of the U.S. Code, and

WHEREAS, As part of this compliance, faculty, staff and students are encouraged to fully avail themselves of the special provisions of the law for teaching, scholarship and research in a non-profit educational institution, including but not limited to, the Fair Use (Section 107), distance education (Teach Act), and Reproduction and Distribution by Libraries and Archives provisions (Section 108), and

WHEREAS, The Board of Trustees for the Connecticut State University System has an obligation to ensure that faculty, staff and students have access to the information and resources necessary to make informed decisions about the use of copyrighted materials in compliance with the Copyright Law of the United States, therefore be it

RESOLVED, That the Board of Trustees for the Connecticut State University System adopts this policy ensuring compliance with the provisions of the United States Copyright Law, Title 17 of the U.S. Code, and be it further

RESOLVED, That the Board of Trustees for the Connecticut State University System directs the Chancellor to ensure compliance with the provisions of the Teach Act and that there is established an ongoing educational program for CSU faculty and staff.
